Maqāṣid al-Sharīʻah vs. Conventional Perspectives: Examining the Eligibility Criteria for Regulatory Capital Instruments
December 28 @ 3:00 pm - 5:00 pm
This lecture examines the intersection between Maqāṣid al-Sharīʻah perspective and conventional perspective with respect to wealth protection and the stability and resilience of financial systems in absorbing shocks and maintaining vital services.
Using regulatory capital instruments as a case study, the lecture highlights both the similarities in the overall objectives of Maqāṣid al-Sharīʻah and conventional perspectives, and the stark differences regarding eligibility criteria for these instruments. Specifically, the lecture will focus on four criteria: the nature of the instrument used in structuring AT1 regulatory capital, the hierarchy of the instrument in relation to CET1 and other instruments, the nature of profit distribution and coupon payments, and the loss absorption mechanisms.
